These terms apply to backpr.com and to the BackPR registration, payment and program management service (the “Service”). By creating an account or using the Service on behalf of an organization (“you”), you agree to these terms on that organization's behalf. Families who register with an organization through BackPR also agree to follow these terms when using the Service. Our privacy policy explains how we handle personal information.
1. Accounts
Keep your account information accurate, keep sign-in details secure, and make sure everyone you give access to follows these terms. You are responsible for activity in your organization's account.
2. Free access for nonprofits
Registered nonprofit and tax-exempt organizations in the United States may use the Service with no subscription and no BackPR fees. We may ask for documentation of nonprofit or tax-exempt status. If an organization is not eligible, we'll let you know and offer a quote.
3. Fees for other organizations
Organizations that are not nonprofits pay the fees set out in the quote they accept. Fees do not include taxes, which you are responsible for where they apply.
4. Payment processing
Payments you collect through the Service are processed by Stripe and are subject to Stripe's terms, which you accept when you set up payments. Stripe charges its processing fees on each payment. BackPR does not add its own fee to what families pay. If you choose to pass processing costs on to families, you are responsible for doing so in line with applicable laws and card network rules. You are responsible for refunds, disputes and chargebacks related to your programs.
5. No long-term commitment
You can stop using the Service and cancel your account at any time. BackPR does not charge cancellation or exit fees.
6. Your data
Your organization owns the data it puts into the Service. You can export it at any time at no cost. Before closing your account, please export anything you want to keep. You can ask us to delete your data after your account is closed.
7. Your responsibilities
- Use the Service lawfully and only for your organization's programs.
- Get any permissions you need from parents, guardians and participants for the information you collect and the messages you send.
- Set your own program policies, such as schedules, prices, cancellations and refunds, and follow them.
- Follow the laws and licensing rules that apply to your programs.
8. Acceptable use
Don't misuse the Service. This includes trying to access accounts or data that aren't yours, interfering with the Service, sending spam, uploading unlawful content, or using the Service to collect payments for anything other than legitimate programs and activities.
9. The Service
We work to keep the Service available and secure and may improve or change features over time. Support is available by email at support@backpr.com.
10. Intellectual property
BackPR owns the Service, including its software, design and content. You may use the Service only as these terms allow. If you send us feedback or suggestions, we may use them without obligation to you.
11. Disclaimers
The Service is provided “as is” and “as available.” To the extent permitted by law, BackPR disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
12. Limitation of liability
To the extent permitted by law, BackPR will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. BackPR's total liability for any claim relating to the Service is limited to the amount you paid BackPR in the twelve months before the claim, or one hundred US dollars, whichever is greater.
13. Indemnity
You will defend and indemnify BackPR against claims arising from your programs, your content, or your violation of these terms or the law.
14. Suspension and termination
We may suspend or close accounts that violate these terms or put the Service, other users or families at risk. Where we reasonably can, we'll give notice and a chance to export your data.
15. Changes to these terms
We may update these terms from time to time. We'll change the date at the top of this page and, for significant changes, notify organizations before they take effect.
