These Terms of Service (“Terms”) govern your use of BackPR’s platform and related services. By accessing or using any part of our platform, you agree to comply with and be bound by these Terms. If you do not agree, please do not use our services.

These Terms apply to all users of BackPR, including schools, camps, nonprofits, educational programs, organizational representatives, administrators, and parents.

We may revise these Terms from time to time. When we make material updates, we will notify users via email and/or platform alert. Continued use after changes indicates your acceptance of the updated Terms.

1. About BackPR

BackPR is an AI-powered, all-in-one platform that helps educational and enrichment programs grow and manage operations effortlessly. Our services are designed for:

• Private and charter schools

• Summer and enrichment camps

• After-school and extracurricular programs

• Online educators and nonprofits

• Learning pods, PTAs, and community centers

Our platform includes:

• Online registration and payment processing

• AI-driven marketing and content tools

• SEO-optimized website builder

• Integrated Learning Management System (LMS)

• Performance dashboards and analytics

• High-traffic directory for parent exposure (1M+ monthly visitors)

Service access and feature availability may vary based on your selected plan.

2. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

By using BackPR, you agree to:

• Provide accurate and up-to-date information

• Use the platform only for lawful purposes

• Notify us immediately of any unauthorized account access

• Not access or use another user’s account without permission

3. Acceptable Use Policy

By accessing BackPR, you agree not to:

• Post or share unlawful, abusive, harmful, or misleading content

• Infringe on others’ intellectual property rights

• Attempt to access restricted areas or bypass security protocols

• Use the platform to harass, defame, or defraud others

Violation of this policy may result in suspension or termination of your account.

4. Privacy & Data Protection

• You retain ownership of your personal and program data.

• We do not sell or share your data without consent, except as required by law.

• We comply with relevant data protection laws such as COPPA and GDPR where applicable.

5. Payments, Subscriptions & Cancellations

BackPR offers subscription plans on a monthly or annual basis. Plan fees are clearly displayed during sign-up and may vary based on features, user volume, or custom agreements.

By subscribing, you authorize us to bill your payment method automatically at the start of each billing cycle.

• You may cancel at any time by contacting support@backpr.com.

• To avoid future billing, cancel before your next billing cycle.

• We offer a 15-day or 6-month money-back guarantee, depending on plan eligibility.

• Payments are securely processed via third-party platforms like Stripe. You agree to their terms when using them.

6. Platform Availability

We strive to maintain 99.9% uptime and ensure the platform is reliable. However, scheduled maintenance or unexpected interruptions may occasionally occur.

• We will make reasonable efforts to notify users in advance of planned downtime.

• We are not responsible for service interruptions caused by factors beyond our control (e.g., internet outages, third-party failures).

7. Intellectual Property & Content Ownership

All content you upload to BackPR — such as class descriptions, videos, images, and program materials — remains your property.

By using BackPR, you grant us a limited, non-exclusive license to use your content solely for the purpose of delivering services to you.

All BackPR platform features, tools, designs, code, and AI models are the exclusive property of BackPR and may not be copied or reused without written permission.

8. Limitation of Liability

To the fullest extent permitted by law, BackPR shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to:

• Data loss

• Loss of revenue or program registrations

• Platform access delays or outages

• Errors or omissions in content

Use of the platform is at your own risk. Your sole remedy for dissatisfaction is to discontinue use of the service.

9. Termination

We reserve the right to suspend or terminate your account if:

• You violate these Terms

• You misuse our platform

• Your payment fails or your subscription lapses

You may request account cancellation at any time. Upon termination:

• Access to your dashboard, site, and tools may be removed.

• Your data will be retained for 30 days and then securely deleted unless requested otherwise.

10. Third-Party Services

BackPR may integrate with third-party services (e.g., Stripe, Google Workspace, YouTube) to provide core features.

Use of these services is subject to their own terms and privacy policies. BackPR is not responsible for issues arising from third-party tools.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of New York, USA.

In the event of a dispute:

• You agree to first attempt to resolve the matter informally with us.

• If unresolved, disputes shall be brought exclusively in the courts of New York County, New York.

12. Disclaimer of Warranties

BackPR is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to:

• Fitness for a particular purpose

• Non-infringement

• Availability, accuracy, or reliability of features

We make no guarantee that the platform will meet your specific needs or be error-free.

13. Indemnification

You agree to indemnify and hold harmless BackPR, its affiliates, partners, and team members from any claims, damages, losses, or legal fees arising out of:

• Your use of the platform

• Your violation of these Terms

• Your infringement of another’s rights
